End-User License Agreement (EULA)

This End-User License Agreement (the “Agreement”) is a legally binding agreement between Cybermap360 S.A. in Switzerland (referred to as “Cybermap360”) and the firm that registered as “Your firm” on the Sign-up window of www.cybermap360.ch (referred to as the “Firm” or “User”). By using the software available on www.cybermap360.ch (referred to as the “Software” or “Cybermap 360”), the User acknowledges and accepts the terms of this Agreement.
The terms “you” and “your” refer to the User, which includes the Firm, all its entities, and all its employees. An entity (referred to as “Entity/Entities”) is defined as a legal entity belonging to the Firm that acts as a firm together. Any entity seeking recognition must ensure that Cybermap360 recognizes it as such. This Agreement does not cover clients, providers, partners, or any other entities that do not meet the above definition of Entities. They must obtain their own license.
- Grant of License:
Cybermap360 grants the User a personal, non-transferable, and non-exclusive license (the “License”) to use the Software in accordance with the terms of this Agreement. The License applies to the current version of the Software and any future versions, as well as support and consulting services. This License applies to the free trial of the Software.
- Ownership and Restrictions:
Cybermap360 retains full ownership of the Software and all intellectual property rights. The User shall not reproduce, copy, distribute, resell, or use the Software for any commercial purpose. The User shall not allow third parties to use the Software on behalf of or for the benefit of any third party. The User shall not use the Software in any way that violates applicable laws.
- Data and Security:
The User’s data is encrypted end-to-end, both at rest and in transit. Cybermap360 does not have access to the User’s data. However, Cybermap360 makes daily backups of the system and has the ability to restore the system in case of an incident.
Please note that Cybermap 360 does not offer direct protection against cyber-attacks, viruses, or malware. It is the User’s responsibility to ensure that appropriate hardware and software protection is in place to guard against any type of cyber-attack or hacking.
- Limitation of Liability:
Cybermap360, its employees, and third-party providers shall not be liable for any direct or indirect financial or non-financial damages caused by the Software. This includes total or partial loss, leakage, or alteration of data. The Parties shall not be liable for any third-party software required to use the Software. No financial or non-financial compensation will be provided by the Parties under any circumstances.
This Agreement is effective upon the User’s first use of the Software and will continue until terminated. Cybermap360 may terminate this Agreement immediately if the User fails to comply with any of its terms. Upon termination, the granted License will cease, and the User must cease all access and use of the Software. Certain provisions will survive the termination of this Agreement.
- Data Erasure:
In the event of termination, the User may request Cybermap360 to erase all data associated with its tenant. Cybermap360 will fulfill this request within 10 business days. Once the data is erased, reactivation of the User will not be possible, and the data will be permanently deleted.
- Governing Law:
This Agreement and any disputes arising from it shall be governed by and construed in accordance with the laws of Switzerland.
